Is the 9th Circuit Court out of line?

A blog post about the 9th Circuit Court of Appeal’s attempt to overturn President Trump’s immigration ban caught the eye of Armstrong and Getty this week.

Ilya Shapiro, senior fellow of constitutional studies at the Cato Institute wrote that it was “a dog’s breakfast of a ruling on a dog’s lunch of an executive order.”

Shapiro joined the Armstrong and Getty Show to discuss his feeling about the decision. He expresses dissatisfaction in both the 9th Circuit Court and Trump’s new policy. Joe Getty inquired about Shapiro’s feelings on the Court.

“How comfortable are you in saying that the 9th Circuit Court practices results oriented jurisprudence?” He asked. “They rule for the result they want,” he asked.

Judges are supposed to rule based on whether or not issues are lawful, not based on their own morality. Joe wonders if the court failed in this way.

“I’d be more comfortable in saying that they’re legal theories, or understanding of the judge’s role is not a good one.”

Shapiro responded. “They’re fully legitimate, and exercise legitimate power… but I think their view of constitutional and statutory interpretation does not jive with the words on the page.”

President Trump was quick to respond to the Circuit Court via Twitter. “See you in court,” he said.
